Terms & Conditions
Effective Date: March 29, 2026
By registering an account, purchasing tokens, or applying for job vacancies on this platform (“the Platform”), you agree to be bound by the following Terms and Conditions.
1. Job Seeker Terms
1.1 Eligibility and Account Registration
- Minimum Age: You must be at least 18 years old to create an account and apply for jobs through the Platform.
- Identity Verification: You agree to provide accurate, current, and complete information during registration, including your full legal name, valid contact information, National ID or Passport number, and true professional qualifications.
- Single Account Policy: Users are restricted to maintaining one active job seeker account. Multiple accounts created to exploit free promotional tokens or manipulate platform metrics will result in immediate termination.
1.2 Token System, Payments, and Non-Guarantee
- Nature of Tokens: Tokens are digital utility units purchased on the Platform to unlock features, including but not limited to submitting job applications, highlighting CVs, or contacting employers directly.
- Tokens Are Not Guarantees: Purchasing or spending tokens allows access to platform services only. It does not guarantee employment, job interviews, or responses from employers.
- Token Purchase & Non-Refundability: All token sales (via M-Pesa, card, or local payment channels) are final and non-refundable, except where required by law or in the event of a verified technical error on the Platform.
- No Agency Fee Status: The fee charged for tokens is strictly an operational software service fee for using the digital platform and does not constitute a recruitment or placement guarantee fee.
1.3 User Conduct and Integrity of Information
- Truthfulness: All details in your profile, resume/CV, certificates, and job applications must be genuine and accurate. Uploading fraudulent academic credentials or false employment history is strictly prohibited.
- Prohibited Content: You agree not to post, upload, or transmit any offensive, discriminatory, defamatory, or unlawful content.
- Direct Solicitation & Off-Platform Deals: You must refrain from engaging in fraudulent financial arrangements or paying money directly to employers outside the platform for job offers.
1.4 Safety, Fraud Warning, and Disclaimer
- No Third-Party Employment Fees: Legal employers in Kenya do not ask job seekers to pay “interview fees,” “medical processing fees,” or “uniform fees” before or after hiring.
- Reporting Scams: You are required to immediately report any employer on the platform who demands direct monetary payments, bribes, or personal financial details outside the system.
- Limitation of Liability: The Platform acts as a venue connecting employers and candidates. The Platform is not an employer, recruitment agency, or party to any employment contract made between you and a hiring company.
1.5 Data Privacy and Protection
- Compliance with Laws: Personal data collected (including contact details, resumes, and identification) is handled in accordance with the Kenya Data Protection Act, 2019.
- Data Sharing with Employers: By applying for a job listing using your tokens, you explicitly authorize the Platform to share your profile, resume, and contact details with the prospective employer posting that vacancy.
- Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
1.6 Account Suspension and Termination
The Platform reserves the right to suspend or permanently delete your account, forfeit remaining token balances, and restrict access without notice if you:
- Breach any provision of these Terms and Conditions.
- Provide false or misleading credentials.
- Engage in abusive, harassing, or fraudulent behavior toward employers or platform administrators.
2. Employer Terms
2.1 Eligibility and Corporate Verification
- Entity Verification: You represent and warrant that you are a legitimate business, registered company, or authorized individual employer operating lawfully in Kenya or internationally.
- Accuracy of Business Information: Employers must provide complete and truthful business details during registration, including official company names, physical address, business registration numbers (or National ID for individual employers), and official corporate contact information.
- Account Security: You are responsible for all activities and job postings published under your account credentials.
2.2 Prohibition of Job Seeker Charging
- Zero Recruitment Fees Policy: In compliance with Kenyan labor law standards, employers are strictly forbidden from charging job seekers any money under any pretext. This includes charging for application processing, interview fees, medical examinations, background checks, training, or uniform costs.
- Immediate Termination for Extortion: Demanding direct monetary compensation, M-Pesa payments, or bribes from job seekers found through the Platform will result in immediate termination of your account, forfeiture of paid tokens, and referral to law enforcement authorities.
2.3 Job Posting Guidelines and Compliance
- Bona Fide Vacancies: You may only post legitimate, active employment or internship opportunities. Multi-level marketing (MLM), pyramid schemes, commission-only traps without disclosure, or illicit services are strictly prohibited.
- Non-Discrimination: All job listings must comply with the Constitution of Kenya and the Employment Act of Kenya. Job posts must not discriminate against applicants based on race, gender, tribe, religion, age, disability, marital status, or pregnancy.
- Content Accuracy: Job posts must clearly outline duties, required qualifications, working conditions, and remuneration terms without deceptive language.
2.4 Tokens, Payments, and Service Usage
- Platform Tokens: Employer features—such as publishing listings, bumping job ads, or unlocking candidate database contacts—are accessed using the Platform's token system.
- Non-Refundability: Token purchases are final and non-refundable once credited to your account balance, regardless of whether a position is filled or candidate applications are received.
- No Guarantee of Candidates: The Platform facilitates candidate exposure but does not guarantee job applicant volume, quality, or contract execution.
2.5 Candidate Data Protection and Confidentiality
- Data Protection Compliance: As an employer accessing job seekers' personal profiles and resumes, you act as a data controller/processor under the Kenya Data Protection Act, 2019.
- Permissible Use: Applicant data acquired through the Platform must be used solely for evaluating candidates for the specific job vacancy applied for.
- Prohibited Data Exploitation: Selling, sharing, spamming, or redistributing applicant personal data (phone numbers, email addresses, resumes) to third parties without candidate consent is illegal and grounds for legal prosecution.
2.6 Employment Contracts and Legal Obligations
- Independent Relationship: The Platform acts solely as an intermediary matching service. The Platform is not party to any employment contract formed between you and a hired job seeker.
- Employer Obligations: Employers are solely responsible for ensuring compliance with Kenyan labor laws, including issuing written contracts, statutory payroll deductions (PAYE, NSSF, SHA, Housing Levy), minimum wage standards, and safe working environments.
2.7 Account Suspension, Listing Removal, and Liability
- Content Moderation: The Platform reserves the right to edit, decline, or remove any job posting that violates these Terms or raises fraud alerts without prior notice or refund.
- Indemnity: You agree to indemnify and hold harmless the Platform against any claims, losses, or legal fees resulting from your breach of labor laws, fraudulent postings, or data protection violations.
3. Governing Law and Dispute Resolution
- Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya.
- Dispute Resolution: Any dispute arising out of or in connection with these Terms shall first be resolved through good-faith negotiation. If unresolved, disputes shall be referred to local arbitration or the courts of Kenya.
